Terms of Service

These terms govern your use of the FloorCast3D website and the FloorCast3D desktop application. They’re an agreement between you and RD Apex Software LLC, a Utah limited liability company doing business as FloorCast3D (“FloorCast3D,” “we,” “us”). By installing the app, starting a trial, or subscribing, you agree to these terms.

Your subscription

FloorCast3D is licensed to you, not sold. A subscription grants one named user one seat — a personal, non-transferable, non-exclusive right to use the application while your subscription is active. You may install it on more than one computer you personally use; you may not share a seat between people. You may not resell, sublicense, redistribute, or reverse-engineer the software, or present its output as a certified engineering product of your own.

Free trial

New accounts get a 14-day free trial with no charge up front. If it’s not for you, cancel before the trial ends and you won’t be billed — simply stopping use of the app does not cancel the subscription, which otherwise begins billing automatically when the trial expires.

Billing

Subscriptions are $199/month or $1,990/year and renew automatically until canceled. Billing, invoicing, and tax collection are handled entirely by Paddle, our merchant of record. Paddle, not FloorCast3D, is the seller of record for your subscription, and Paddle’s own buyer terms, presented at checkout, apply to your purchase. We don’t receive or store your card details. Who owns what

You own everything you create. Every layout, drawing, DXF, PDF, bill of material, quote, placard, and export you generate with FloorCast3D is yours — to use, modify, sell, rebrand under your own name, and hand to your own customers, without restriction, royalty, or attribution to us. We claim no ownership or license in it, and we will not use your projects, drawings, customer names, or facility layouts publicly without asking you first and getting your agreement in writing.

We own the software: the application, its code, drawing templates, and bundled reference data remain ours. Manufacturer names and product designations that appear in the application, its output, or this site’s reference pages are the trademarks of their respective owners, used to identify the products a layout specifies; we are not affiliated with, endorsed by, or acting for any of them.

Acceptable use

Use FloorCast3D lawfully and for its intended purpose: planning, quoting, and drawing warehouse rack layouts. Don’t attempt to circumvent licensing or security controls, don’t redistribute the software, and don’t use the application in a way that could harm FloorCast3D, its infrastructure, or other users.

Professional disclaimer

FloorCast3D’s layouts, capacity estimates, quotes, and drawings are budgetary and advisory tools meant to help you plan faster. They are not engineering or permit advice, and no output from FloorCast3D is a substitute for review by a licensed engineer. Always verify all drawings and capacities with your Authority Having Jurisdiction (AHJ) and a licensed engineer before construction. Drawings you generate carry your own company name in their title block, because you are the one issuing them — you are responsible for reviewing what you distribute under your name.

No warranty

FloorCast3D is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and the accuracy or completeness of any output. We do not warrant that the service will be uninterrupted or error-free, or that any output will be accepted by any authority.

Cancellation, and what you keep

You may cancel at any time, effective at the end of your current billing period. When a subscription ends — by cancellation, lapse, or termination — you keep the ability to open and view projects you’ve already created. You lose the ability to generate new deliverables: drawings, exports, bills of material, quotes, placards, and packages. This is deliberate: your projects are your records, and ending a subscription stops you buying new output — it does not lock you out of your own work. We may suspend or terminate access for breach of these terms.

Limitation of liability

To the maximum extent permitted by law, FloorCast3D’s total liability to you for any claim arising from these terms or your use of the software is limited to the subscription fees you paid in the 12 months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, project delay, rework, or the cost of correcting or replacing anything built from FloorCast3D’s output. Some jurisdictions don’t allow some of these limits; where that’s so, they apply only as far as the law permits.

Support

Support is by email at support@floorcast3d.com and is included with an active subscription. We aim to respond within two business days. These terms don’t commit us to a specific response time, uptime level, or future feature.

Governing law and general terms

These terms are governed by the laws of the State of Utah, USA, without regard to conflict-of-law principles, and the state and federal courts serving Davis County, Utah are the exclusive venue for any dispute, except that either party may seek injunctive relief anywhere appropriate. If a provision is unenforceable, the rest stands. Neither party is liable for failure to perform caused by events beyond its reasonable control. We may assign these terms to an affiliate or to a successor in a merger, reorganization, or sale of the business, and your rights under them are unaffected by the change; you may not assign them without our consent. These terms are the entire agreement between us about FloorCast3D. Notices to us: support@floorcast3d.com.

Changes to these terms

We may update these terms as FloorCast3D evolves. We’ll update the date above when we do, and for material changes we’ll give notice by email or in the application before they take effect. Continued use after that means you accept the updated terms.
